Our Privacy Policy
Although the work of a data privacy professional means talking about personal data every day, in practice we need to
handle very little personal data ourselves. We’ll always seek to minimise the personal data we collect and use in our
work, but it’s inevitable that we’ll need some data in order to work effectively and operate our business so this policy
explains what personal data Wiseman Data Privacy collects, for what purposes, and how we use it.
Terms and Definitions
In this policy, ‘we’, ‘us’ and ‘our’, of course, refer to Wiseman Data Privacy (hereafter ‘WDP’), which is a trading
name of Louise Wiseman Limited, registered address: 3 Charnwood Street Derby, DE1 2GY. We’re a ‘data
controller’ for the purposes of data protection law, which means we’re accountable for the way we use your
personal data and must comply with data protection law, which is regulated in the UK by The Information
Commissioner’s Office (‘ICO’), the UK’s data protection regulator. ‘You’, ‘your’ and ‘yours’ refer to you, the client.
‘Your personal data’ is used here, depending on context, to refer to the personal data held by your organisation and
used by WDP while working with you, or to the personal data held by WDP of any individual within that organisation.
In this policy and on this website, the terms ‘personal data’ and ‘personal information’ are used interchangeably to
refer to information that data protection law defines as ‘personal data’. That’s basically information about an
identifiable living person which, in this context, will mostly be about the people we deal with in your company.
‘Current Data Privacy law and regulation’, ‘Data privacy law’ or ‘Data Protection law’, refers to the data
protection law and regulation that’s in force in the UK and Europe. At the time of writing (August 2021), that’s
principally EU General Data Protection Regulation 2016/679 (‘GDPR’) as applicable in the UK, the UK Data
Protection Act 2018, the Privacy and Electronic Communications Regulations 2003 (as amended most recently
2018), and applicable secondary and supporting law and regulation. If you’re outside Europe, you should instead
take those terms to mean the applicable legal and regulatory framework around data privacy in your country.
What information does Wiseman Data Privacy collect about me?
•
On this website: None. The site does not use cookies or other tracking technologies to collect data
•
Enquiries: If you contact us, we’ll have your contact details and anything you put in an e-mail but we won’t hold
onto them unless you decide to take things forward.
•
Information needed while we’re working together: To provide you with the service you’ve asked for, we may
need some information about individual employees of your business but it’s likely to be limited to contact details
and e-mail correspondence. If we ask for any other personal information about an employee or any other person
(such a customer or a supplier contact), we’ll explain why we need it and will only use it for that specific purpose.
•
Information provided by someone else: The information we hold will usually come directly from you.
Occasionally it may be that a mutual contact gives us your details and suggests we get in touch with you and in
that case, we’ll tell you who they are and check that anything they’ve told us is correct. Unless you opt to work
with us, or ask us to contact you at a later date, we won’t contact you again or hold onto your details.
•
Information you share while we’re working together – confidentiality: In the course of working together,
anything we see, hear or read will remain confidential. That applies to all types of information, not just personal
data. We won’t discuss or share it with anyone else at any time. In the interests of transparency, though, please
do read the paragraph entitled ’Sharing information’, which outlines extreme circumstances in which we might be
compelled to share information.
How does Wiseman Data Privacy use my personal information?
We’ll use personal data only as necessary:
•
to provide you with the agreed products and services.
Without this data you and WDP simply wouldn’t be able to enter a viable working relationship.
•
to maintain our business accounts and records.
This is essential and legitimate for any business and doesn’t adversely impact on the privacy of any individual.
•
To defend or protect our interests in the unlikely event of legal proceedings or dispute between you and
WDP
If we need or want to use your personal data for any other purpose, we’ll ask you first and you’ll be free to say no.
Marketing
WDP may occasionally contact past customers to see if they would like any further help or guidance. Our customers
are businesses rather than individuals but we appreciate that sometimes, particularly with smaller businesses, this
may effectively mean marketing to an individual person. If that’s the case and you ask us not to contact you again, or
not to use a particular set of contact details for business-related communications, we will respect that.
How long do you keep my personal information?
We keep personal information for the shortest length of time needed to meet our legal obligations and keep
accurate, meaningful business records. That generally means keeping basic details (who, what, how much, how
and when) for seven years for tax purposes and any other personal data we may have about you for a maximum of
twelve months after we finish working together.
Is my personal information transferred outside Europe?
WDP is a UK business, and we do not outsource any services or send any data outside the UK . Like most
businesses and individuals today, we use Microsoft and Apple products . Both have servers located around the
world so it’s likely that your personal data is, in practice, stored outside the UK. That is a fact of modern business
and if you have any objection to either those corporations or any of the countries in which they are located, WDP will
be unable work with you!
Who does Wiseman Data Privacy share my personal information with?
We do not share your personal information unless:
•
you ask us or give us consent to do so,
•
it’s an unavoidable part of the information we’re required to share with our tax advisors or other similar
professionals,
•
You and WDP are in dispute and we need to involve police, lawyers, a debt-tracing agent or similar to protect or
defend our interests, or
•
The police or a government body like HMRC present us with a valid warrant or court order for specific
information.
What rights do I have over my personal information?
Data Privacy law gives people rights over their personal data. WDP is primarily a business-to-business operation,
and the small amount of personal data we collect about any individual is essential to our business, which means
most of those rights won’t apply in this context. For that reason, and to avoid an unnecessarily long policy, we do not
go into detail here about your data privacy rights but are happy to answer any questions or provide you with more
detail on request. You can also find more information on the ICO website (link at the end of this document), which is
a great resource on all aspects of data protection. We do, however, want to make you aware of three rights that
could apply:
•
The right to have errors in your personal data rectified.
If you think we’re holding personal data that’s inaccurate, please let us know and we will update it.
•
The right to a copy of the personal information we hold about you.
WDP holds very little personal data but will comply with any valid request from an individual who wishes to see
any data we do hold about them. We will also assist you in dealing with any such requests your business
receives from its customers or employees, by providing you, on request, with any relevant personal data you may
have passed to us.
•
The right to complain to the Information Commissioner’s Office (ICO).
You have the right to complain to the ICO if you believe WDP has breached data privacy law. We hope this
never applies, and that if there’s ever a problem we’ll be able to resolve it amicably between us, but you can find
the ICO at https://ico.org.uk. If you are based outside the UK, you may prefer to contact your own local data
protection authority.
